§ 7522, by manufacturing, selling, and/or offering for sale certain Motor Vehicle parts or components, the principal effect of which is to bypass, defeat, or render inoperative a Motor Vehicle Emission-Related Element of Design or device WHEREAS, the Complaint alleges that Thunder Diesel and Flo~Pro violated Section 203 of the Clean Air Act ("Act"), as amended, 42 U.S.C. d/b/a Flo~Pro Performance Exhaust ("Flo~Pro") and Schumacher Estates Ltd. ("Thunder Diesel"), Red Deer Exhaust, Inc. WHEREAS, Plaintiff United States of America, on behalf of the United States Environmental Protection Agency ("EPA"), has filed a Complaint in this action concurrently with this Consent Decree against Thunder Diesel & Performance Co.
